HOA CC&Rs
The recorded covenants, conditions, and restrictions of a homeowners association that bind properties within it.
CC&Rs can prohibit or restrict short-term rentals independently of city law, and both apply at once — the most restrictive wins. An HOA can only enforce an STR ban that is in its recorded CC&Rs, not merely a board vote, but where it exists it can override a city that otherwise allows STRs.
