The 1994-era Lodging Overlay (LO) and Planned Resort Zone (Snow King) are the only areas where unrestricted STR use is allowed; the LDR use schedule permits Short-Term Rental Units only with a BUP and only in the Lodging Overlay ('B(LO)') in commercial/mixed-use zones. Since January 1, 2024, STRs are also allowed OUTSIDE the overlay in residential zones NL-1 to NL-5, NM-1, NM-2, NH-1, R, MHP, and OR, but limited to 3 separate rentals and 60 total rental nights per calendar year, with annual BUP renewal (expires December 31 each year) and annual notification of neighbors within 200 feet (and any HOA). Inside the Lodging Overlay, an individual STR unit may not exceed 1,500 sq ft of habitable floor area (Ord. 1402, 2024).

Outside the Lodging Overlay, the 'Basic Use Permit - Short-Term Rental' costs $543 per bedroom (initial application fee) plus a $543 annual renewal fee. A Town Business License is also required and renewed annually (business license fees on the same schedule range roughly $136-$179 for most small operators; the 'Residential Rentals' license category is $139 -- the town's schedule does not state which license category applies specifically to STRs). Operating without a required permit incurs double the permit fee (LDR 8.9.2.D).
