Step by step

  1. 1

    Confirm your property is eligible

Confirm the property's zoning allows short-term rentals. Short-term rentals are permitted in every zoning district in Nags Head โ€” no STR-specific zones, overlays, or density caps. Two forms exist: 'whole house' (entire single-family dwelling rented to one housekeeping unit for fewer than 30 days) and 'partial house' (a resident-occupied single-family dwelling renting up to 2 guest rooms for fewer than 30 days). Renting more than 2 bedrooms in a resident-occupied home may be treated as a bed and breakfast, which is zoning-dependent and requires a conditional use permit. Whole-house STRs need no parking beyond the standard single-family requirement (bedrooms minus two, minimum two spaces); partial-house STRs need one additional space. Separately, an October 2024 housing ordinance deed-restricts new multi-family dwellings to leases of 90+ consecutive days, keeping new multi-family stock out of the STR pool.

  2. 2

Apply for the Short-Term Rental Registration

Submit the Short-Term Rental Registration application to Nags Head and pay the $25 fee. $25 per short-term rental, due with initial registration and each annual renewal. Registration applies only to STRs NOT managed by a real estate broker as defined in G.S. 93A-2(a); broker-managed rentals (a large share of Outer Banks inventory), hotels/motels regulated under Chapter 72, rentals to persons with no other primary residence, and rentals for nominal consideration are exempt.

  3. 3

    Register for occupancy taxes

Register to collect and remit the applicable lodging/occupancy taxes for Nags Head. Some are collected automatically by the booking platform and some you may need to remit yourself.

  4. 4

    Renew on schedule

The permit renews annual โ€” set a reminder so it never lapses, since operating on an expired permit typically triggers fines.
